Born-Alive Abortion Survivors Protection Act
Introduced Jan 15, 2025 · Cloture on the motion to proceed to the measure not invoked in Senate by Yea-Nay Vote. 52 - 47. Record Vote Number: 11. (CR S294-295)
What does this mean?

If a baby is born alive after an abortion or attempted abortion, this bill requires the doctor or other medical staff in the room to give that baby the same medical care they'd give any other newborn at that stage of development, including getting the baby to a hospital right away. Anyone who witnesses a failure to do this must report it to the police, and doctors or staff who don't provide proper care or don't report violations can face fines and up to five years in prison. Someone who deliberately kills a baby born alive in this situation could be charged with murder. The mother herself cannot be criminally charged under this law, and she's given the right to sue the medical practitioner or staff involved if these rules are broken.
