S. 5271 · Government Operations and Politics
A bill to amend the Help America Vote Act of 2002 to require voters to provide photo identification.
Introduced Aug 5, 2026 · Cloture on the motion to proceed to the measure not invoked in Senate by Yea-Nay Vote. 52 - 46. Record Vote Number: 231.
What does this mean?

This bill would require voters in federal elections (like elections for President or Congress) to show a physical photo ID, such as a driver's license, before getting a regular ballot. If someone shows up without one, they can still vote using a provisional ballot — a backup ballot that only gets counted after election officials verify the person was actually eligible to vote — but that ballot won't count unless the voter shows valid ID within three days, or signs a sworn statement saying they don't have one due to a religious objection to being photographed. For people voting by mail or other non-in-person methods, they'd need to include a copy of their photo ID or the last four digits of their Social Security number plus a signed statement explaining they couldn't get an ID despite trying; this ID requirement wouldn't apply to military members voting from overseas or to certain elderly or disabled voters. States would also be expected to make free photo-copying machines available so people can copy their ID to submit with their ballot. These changes would start the day after the bill becomes law.
