H.R. 9340 · Energy
Ratepayer Protection Act
Introduced Jun 18, 2026 · Motion to proceed to consideration of measure withdrawn in Senate. (CR S5199)
Amendment adopted
Sen. Warner, Mark R. [D-VA] (D-VA)

What does this mean?

Big electricity users like data centers, meaning facilities that use at least 100 megawatts of power at one site (roughly what tens of thousands of homes use) to store data or run computing services, would be asked to pay the full extra cost of any new power plants, power lines, or equipment a utility must build to serve them. The bill doesn't order this directly: it requires state utility regulators (the government bodies that approve what power companies can charge) and utilities not overseen by those regulators, such as some publicly owned ones, to consider adopting this standard. Under the standard, the rates charged to these customers would cover those upgrade costs, including costs left over if the customer ends its contract or stops buying power. Before the utility builds anything, the customer would also have to put up financial guarantees or contributions to cover the upgrade costs.
