H.R. 7401 · Commerce
Small Business Lending Fraud Prevention Act
Introduced Feb 5, 2026 · Received in the Senate and Read twice and referred to the Committee on Small Business and Entrepreneurship.
What does this mean?

The Small Business Administration, the federal agency that helps small businesses get loans by guaranteeing or backing them through banks, would have to make its own staff sign a written statement before working on any loan. Specifically, any SBA employee involved in approving, reviewing, or setting up a loan must certify that they don't have a personal financial stake or relationship that could bias their decision, and promise to speak up if such a conflict shows up later. This doesn't create a brand-new rule out of nowhere — federal employees already have to avoid conflicts of interest — but it forces the SBA to spell out and formally document that requirement for loan-related staff, and the agency will need to write official rules explaining exactly how this will work in practice.
