H.R. 21 · Crime and Law Enforcement
Born-Alive Abortion Survivors Protection Act
Introduced Jan 3, 2025 · Received in the Senate and Read twice and referred to the Committee on the Judiciary.
What does this mean?

If a baby is born alive after an abortion or an attempted abortion, this law would require the doctor or nurse in the room to give that baby the same medical care any other baby born at the same age would get, and to get the baby to a hospital right away. Medical staff who see this care not being given would have to report it to the police, and failing to provide the care or failing to report it could lead to fines or up to five years in prison. Someone who deliberately kills a baby born alive in this situation could be charged with murder, but the mother herself couldn't be criminally charged — instead, she'd be allowed to sue the doctor or staff member in civil court if the rules were broken.
